2. Scope and nature of the service
These terms govern the use of SmartSocial, available at smartsocial.it. SmartSocial is a social media scheduling and publishing tool, installed and operated directly by the controller.
The service is open to registration. Each user has a separate workspace in which they connect their own social channels and manage their own content.
SmartSocial is currently in its launch phase: access is free and no payments are active. The controller may introduce paid plans in the future; if so, pricing will be announced in advance and will not apply retroactively to the period already used.
3. Accounts and credentials
Account holders are responsible for keeping their credentials confidential and for the activity carried out through their account. API keys and tokens generated by the application must be treated as passwords: whoever holds them can publish on your behalf. Any unauthorised use must be reported without delay.
4. Acceptable use
The service must be used in compliance with the law and with the terms of the connected social platforms. In particular, you may not:
- publish unlawful or defamatory content, or content infringing third-party or copyright rights;
- use the service for bulk unsolicited messaging, abusive automation, or to circumvent the limits imposed by the connected platforms;
- attempt to access areas, data or accounts belonging to others, or compromise their security.
5. Content
The content you upload remains yours. You are responsible for it and you warrant that you hold the rights required to publish it on the platforms you have selected. The controller claims no ownership over it and processes it solely to provide the service.
Remember that uploaded files are publicly accessible via their URL, because social platforms must be able to download them in order to publish them. This is explained in the privacy notice.
6. Third-party platform integrations
SmartSocial publishes through the APIs of X, LinkedIn, Meta (Facebook, Instagram, Threads), TikTok and Google (YouTube). Those platforms are independent parties with their own terms of service, which continue to apply to your use. They may change, restrict or discontinue their APIs at any time: a publication may therefore fail, be delayed, or be removed at the platform's discretion, for reasons outside SmartSocial's control.
7. Availability and disclaimer of warranties
The service is provided "as is", without warranty of continuous operation, freedom from errors, or fitness for a particular purpose. No service level agreement (SLA) and no support service are provided. The controller may suspend, modify or discontinue the service, in whole or in part, including without notice.
8. Limitation of liability
To the extent permitted by law, the controller is not liable for indirect damages, loss of data, loss of profit, or for the failure, delay or removal of a publication by the connected platforms. Nothing in these terms excludes or limits liability where such exclusion is not permitted by applicable law, in particular in cases of wilful misconduct or gross negligence.
9. Suspension and termination
The controller may suspend or close an account in the event of a breach of these terms, of use that endangers the security or stability of the service, or where required by law. You may disconnect your social channels at any time and request deletion of your account and related data.
10. Changes to these terms
These terms may be updated. The applicable version is the one published on this page, together with its last-updated date.
11. Governing law and jurisdiction
These terms are governed by Italian law. Any dispute falls under the jurisdiction of the courts of the place where the controller has its registered office, without prejudice to mandatory consumer protection provisions.
